USPTÖ Trademark Services, LLC ("USPTÖ", "we", "us") is a private trademark services provider. We are not a law firm, do not provide legal advice, and are not affiliated with the United States Patent and Trademark Office or any other government agency. Where attorney representation is required, we coordinate with independent licensed counsel.
2. Engagement and scope
Each engagement is governed by a written services agreement that describes the scope, deliverables, fees, and timing. Government filing fees are separate from our service fees and are paid to the USPTO at your direction.
3. Client responsibilities
You agree to provide accurate, complete, and timely information, including the goods or services associated with your mark and evidence of use when applicable. We rely on the materials you provide; misrepresentations may jeopardize your application.
4. No guarantee of outcome
Trademark prosecution involves examiner discretion and third-party rights. We do not guarantee registration, approval, or any particular result. Past outcomes do not guarantee future results.
5. Fees, refunds, and chargebacks
Service fees are due as set out in your engagement letter. Government fees are non-refundable once paid to the USPTO. Service fees are refundable only for work not yet performed.
6. Intellectual property
All website content — including text, graphics, the USPTÖ logo, and design — is owned by USPTÖ Trademark Services, LLC and protected by U.S. and international intellectual property law. You may not reproduce or distribute it without written permission.
7. Limitation of liability
To the maximum extent permitted by law, USPTÖ's total liability arising out of or related to your engagement shall not exceed the fees you paid to USPTÖ for the specific service giving rise to the claim.
8. Governing law
These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any dispute shall be resolved exclusively in the state or federal courts located in New Castle County, Delaware.
9. Changes
We may update these terms periodically. The "Last updated" date reflects the most recent revision. Continued use of the site constitutes acceptance of the revised terms.
